No significant fiscal implication to the State is anticipated.

The bill would amend the Transprotation Code to require the Texas Department of Transportation (TxDOT) to issue special use driveway permits to retail sales establishments operating under a permit issued by another state agency, at locations adjacent to a highway that is part of the state highway system.

Based on the analysis of TxDOT, it is assumed any costs and duties associated with implementing the provisions of the bill could be absorbed within existing resoureces.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or would otherwise take effect on September 1, 2005.

No fiscal implication to units of local government is anticipated.
