The bill would allow peace officers eligible to receive payments as a disabled peace officer under 56.542 (b) to choose the terms of payment as either a single payment paid each year or equal monthly installments. The bill would take effect immediately if it receives a vote of two-thirds of all members elected to each house, or on September 1, 2005 if the Act does not receive the necessary vote for immediate effect.
Currently, the Office of the Attorney General (OAG) Crime Victims Services Division allows the peace officers to choose either a monthly, quarterly, or annual payment. The new legislation will eliminate the quarterly payment the OAG currently allows, but will not impose any new requirements on the OAG.
