No significant fiscal implication to the State is anticipated.


The bill would amend Subchapter D, Chapter 161, Human Resources Code by adding Section 161.074, requiring the Health and Human Services Commission to adopt a rule to develop, and the Department of Aging and Disability Services (DADS) to implement, a pilot program known as the Senior Nutrition Assistance Pilot Program, to provide nutritional supplements and products to elderly persons to improve and maintain their health. The Act also allows the DADS to seek and accept gifts, grants, and donations of funds or property from public or private sources to develop and implement the pilot program.

DADS stated that the DADS Community Based Alternative program and the Area Agencies on Aging (AAAs) and their community partners currently provide nutritional supplements (e.g. Ensure) with physician orders to older individuals across the state. For the AAAs, the items are purchased with Older American Act funds as part of health maintenance services.  It is assumed that the pilot program would be developed within funds currently available.
