No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to the certification of compliance with requirements for sales of certain items to metal recycling entities. 

 

The bill would require a person that sells or transfers to a metal recycling entity a lead-acid battery, fuel tank, or PCB-containing capacitor that is included with another type of scrap, used, or obsolete metal, to certify compliance with the Texas Department of Transportation (TxDOT).  Items part of a nonrepairable motor vehicle acquired by a salvage dealer would have to be certified in accordance with the form prescribed by TxDOT.

 

The bill would take effect September 1, 2005.
