HB2916 by Puente (Relating to a prohibition on the issuance of a permit for an on-site sewage disposal system in violation of certain local regulations. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would prohibit the Texas Commission on Environmental Quality or an authorized agent from issuing a permit under Chapter 366, Health and Safety Code, for an on-site sewage disposal system if the installation or operation would violate an ordinance, order, or rule of a local governmental entity regulating the minimum acreage of a site on which an on-site sewage disposal system may be installed. This prohibition would apply only to the issuance of a permit for a system that is to be installed or operated on a subdivision plat created on or before December 31, 1900.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
