No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to add that a person who constructs, alters, repairs, or extends, or causes to be constructed, altered, repaired, or extended, an on-site sewage disposal system must comply with any local governmental entity's regulation regarding minimum acreage for installation of septic systems, in addition to the existing statutory requirements. The bill would require the Texas Commission on Environmental Quality (TCEQ) to incorporate and enforce any local governmental entity rule or regulation regarding the minimum acreage requirement.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

According to TCEQ, the agency could absorb additional responsibilities using existing resources.
