No significant fiscal implication to the State is anticipated.

The bill would amend Section 643.251, Transportation Code, to repeal the provision allowing an Administrative Law Judge to include in the proposal for decision in certain cases against motor carriers a finding setting out expenses and necessary attorney fees incurred by the state in bringing the administrative proceeding.

Based on the analysis of the Texas Department of Transportation, the State Office of Administrative Hearings, and the Office of the Attorney General, it is assumed any costs associated with implementing the provisions of the bill could be absorbed within existing resources.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2005.
