No significant fiscal implication to the State is anticipated.

The bill would establish a workgroup to recommend definitions, guidelines, and reporting requirements regarding the management of behavior of residents at certain facilities. The executive commissioner of the Health and Human Services Commission would appoint members to the workgroup, made up of representatives of the Department of State Health Services, the Department of Aging and Disability Services, the Department of Family and Protective Services, the Texas Youth Commission, the Texas Juvenile Probation Commission, the federal protection and advocacy system and a number of additional expert members representing facility residents and hospitals.

 

The bill would take effect September 1, 2005 and expire on January 1, 2007.
