No significant fiscal implication to the State is anticipated.

The bill would modify the composition and duties of the Critical Infrastructure Protection Council in the Office of the Governor. The bill would permit the Office of the Governor to allocate available federal and state grants to private entities that perform homeland security activities. The bill would allow for council members to be reimbursed for expenses incurred in performing their duties relating to council activities.
 
The bill would require the Office of the Governor to perform threat risk penetration tests on certain facilities, as determined by the governor, that represent a significant threat risk to statewide critical infrastructure. The bill also would allow the Office of the Governor to contract with a third party or private entity to perform these threat risk penetration tests. Costs for the threat risk penetration tests will be covered by current federal Homeland Security funds.
