LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 5, 2005

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Juvenile Justice & Family Issues

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB3136 by Castro (Relating to certain child support liens against assets in the possession of, or controlled by, financial institutions.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill relates to certain child support liens against assets in the possession of, or controlled by, financial institutions.  The bill would take effect September 1, 2005.

Currently the Office of the Attorney General (OAG) Child Support Division files liens on paying cases under some circumstances, usually on a case with significant arrears and a considerable amount in a financial institution account. The bill would require updates to policies, procedures and training materials. The OAG anticipates any additional work resulting from the passage of this bill could be reasonably absorbed with current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
