HB3168 by Brown, Fred (Relating to the court house security fund), As Introduced

No fiscal implication to the State is anticipated.

The bill would require for a justice court not housed within a county courthouse that 30 percent of the $3 court cost imposed on a misdemeanant be deposited into a Justice Court Building Security Fund to be administered by or under the county commissioners court. The fund shall be used only to finance, purchase, install, and maintain items used for providing security services. The bill would take effect September 1, 2005.

 

Under current statute, the full $3 court cost imposed on misdemeanants goes into the county courthouse fund or the municipal courthouse fund for use on security services. The bill would establish a separate fund for a justice court not located in the county courthouse.


Local Government Impact

No new revenue would be generated as a result of the provisions of the bill. No significant fiscal implication to units of local government is anticipated as a result of reallocating collected court costs.
