No fiscal implication to the State is anticipated.

The bill would amend Section 43.071, Local Government Code, to establish critera for when an annexing municipality would not have to obtain written consent of any other municipality to annex an area located in a water or sewer district that is wholly or partly in the overlapping extraterritorial jurisdiction of two or more municipalities.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

No significant fiscal implication to units of local government is anticipated.
