The bill would amend sections of Chapter 2305 of the Occupations Code, to require a person whose business involves dealing with salvage vehicles, administering certificates of title, or administering vehicle registration to consent to entry or inspection by an employee of the Texas Transportation Commission or the Texas Department of Transportation (TxDOT), a member of the Public Safety Commission, an officer of the Department of Public Safety (DPS), or another peace officer who is interested in tracing or locating a stolen motor vehicle.
When the business or activity regulated by Chapter 2305, Occupations Code, or Chapters 501 or 502, Transportation Code, is also licensed under Chapter 348, Finance Code, as a Motor Vehicle Installment Sales business, and for the purposes of tracing or locating a stolen motor vehicle, only a DPS officer would be authorized to conduct an inspection of documents, records, vehicles, and parts.
The person would be required to fully cooperate; a violation of the requirements would be a Class A misdemeanor.
The bill would take effect September 1, 2005.
While not significant, it is anticipated that the fiscal impact would be positive by enhancing the ability of law enforcement to trace, locate, and identify stolen vehicles. It is anticipated that any costs associated with enforcing, prosecuting, and punishing violators would also be insignificant.
