No fiscal implication to the State is anticipated.
The bill would authorize a magistrate to impose a cash bond not to exceed 10 percent of the bail amount set in a case in addition to assessing a personal bond fee on a defendant released on personal bond. The additional cash bond posted must be deposited, held, and if applicable, refunded to the defendant in the same manner as cash funds deposited for a bail bond. The bill would take effect September 1, 2005 and would apply only to a defendant charged with an offense committed on or after that date.
