HB3256 by Van Arsdale (Relating to requiring approval by certain elected officials for certain proposed toll projects in certain counties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require the written approval of the affected county commissioners, the county judge, and state legislators before the Texas Transportation Commission (TTC) could convert a state highway to a toll road or convey a state highway to a toll road authority. The bill would require TTC to provide certain elected officials prior written notice of a public hearing related to the conversion or conveyance of a state highway. The provisions of the bill would only apply to a county with a population of 3 million or more.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2005.

Based on the analysis of the Texas Department of Transportation, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources.


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
