LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 5, 2005

TO:
Honorable Norma Chavez, Chair, House Committee on Border and International Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB3280 by Campbell (Relating to increasing funding for sheriffs in certain small border counties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to allow the Department of Public Safety (DPS) to make grants to a county for a sheriff in that county if the county 1) has a population of less than 150,000, and 2) is within 250 miles of an international border.  DPS would be required to consider the extent to which the sheriff will use the money to enhance homeland security and fight drug trafficking.  DPS may also adopt rules regarding application and eligibility requirements for the grants.

The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house.  If the bill does not receive the necessary vote, it would take effect September 1, 2005.

Local Government Impact

The bill would result in a positive fiscal impact to those sheriff's departments in the affected counties that apply for, are awarded, and accept a grant from the department.
