No fiscal implication to the State is anticipated.

The bill would authorize a municipality that has entered into a written agreement with a property owner in a district within the municipality's extraterritorial jurisdiction (ETJ) prior to January 1, 2005, and if by that date the municipality and the county have not entered into an agreement determining which entity is authorized to regulate subdivisions in the municipality's ETJ, the municipality would have sole regulatory authority. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
