LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 23, 2005

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB3289 by Swinford (Relating to certain time limits on and the consequences of a delay in the state's readiness to proceed with the trial of a criminal case.), As Introduced

No fiscal implication to the State is anticipated.

The bill would repeal Article 32A.02, Code of Criminal Procedure, which lays out procedures for a speedy trial. The bill would take effect September 1, 2005.

Local Government Impact

County clerks, district clerks, district attorneys, and county sheriffs in different parts of the state and in counties of varying population sizes were contacted regarding the possible fiscal impact of the bill on the court system and the county jails. Responses indicated that while implementing the bill could result in an increase in the length of time in which cases are processed, that the anticipated fiscal impact would likely be insignificant.
