LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 11, 2005

TO:
Honorable David Swinford, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB3305 by Isett (Relating to coercing a woman to have an abortion and parental notification of abortion; creating offenses.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code and the Health and Safety Code as they relate to the coercion of a woman to have an abortion and guidelines for the parental notification of an abortion.  The bill would make the violation a Class A misdemeanor.  The bill would also add coercion to induce a pregnant woman to have an abortion and assault on a pregnant woman in order to force an abortion to the Penal Code.

The Board of Medical Examiners (Board) reports there would be some cost as a result of this bill due to hearings before the Board, but it is assumed that the costs could be absorbed within existing resources.

The bill would take effect September 1, 2005.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
