HB3333 by Chavez (Relating to the sale or transfer of interest of real property to certain federally recognized Indian tribes.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to include a federally recognized Indian tribe whose reservation is within counties of this state bordering the Republic of Mexico and that is not subject to the federal Indian Gaming Regulatory Act among the list of priority buyers/transferees for the sale/transfer of surplus real property and highway rights-of-way.

Based on the analysis of the Texas Department of Transportation, it is assumed duties and responsibilities associated with implementing the provisions of the bill could be accomplished within existing resources.

The bill would take effect immediately upon receiving a two-thirds majority vote of all the members elected to each house.  If the bill does not receive the two-thirds vote necessary for immediate effect, the bill would take effect September 1, 2005.
