LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 4, 2005

TO:
Honorable Norma Chavez, Chair, House Committee on Border and International Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB3333 by Chavez (Relating to the conveyance of property to federally recognized Indian tribes in counties along the Texas-Mexico border.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to include a federally recognized Indian tribe whose reservation is along the Texas-Mexico border among the list of priority buyers/transferees for the sale/transfer of surplus real property and highway right-of-way.

Based on the analysis of the Texas Department of Transportation, it is assumed duties and responsibilities associated with implementing the provisions of the bill could be accomplished within existing resources.

The bill would take effect immediately upon receiving a two-thirds majority vote of all the members elected to each house.  If the bill does not receive the two-thirds vote necessary for immediate effect, the bill would take effect September 1, 2005.

Local Government Impact

No fiscal implication to units of local government is anticipated.
