LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 20, 2005

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB3333 by Chavez (Relating to the sale or transfer of interest of real property to certain federally recognized Indian tribes.), Committee Report 2nd House, As Amended

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to add to the priorities the Texas Commission of Transportation is to consider when transferring or selling real property. Under current statute, priorities are given to a governmental entity with the authority to condemn the property or to the general public. The bill would add landowners whose land abuts or adjoins Tract 11, Block 49 of the Ysleta Grant located in El Paso County.

The bill would require the Texas Department of Transportation (TxDOT) to sell or convey the part of the Presidio International Bridge that is owned by this state to the City of Presidio and the County of Presidio in compliance with state and federal rules.

TxDOT indicates that the federal government could place restrictions on the sale or conveyance of the international bridge.

It is assumed the sale or conveyance would be contingent upon the receipt of a new Presidential Permit for the Presidio International Bridge in accordance with Executive Order 11423, August 16, 1968 (33 Federal Regulation 11741).

Based on the analysis of TxDOT, it is assumed that costs associated with implementing the provisions of the bill could be covered utilizing existing resources.

The bill would take effect immediately upon receiving a two-thirds majority vote of all of the
members elected to each house. If the bill does not receive a two-thirds majority vote of all the members, the bill would take effect September 1, 2005.

Local Government Impact

Costs to the City of Presidio and the County of Presidio would depend on the purchase price of the Presidio International Bridge set by the department and any costs associated with obtaining a Presidential Permit.
