No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize a justice of the peace or municipal court judge to assess an administrative fee not to exceed $20 if the justice or judge dismisses the charge for certain misdemeanor traffic offenses and the defendant meets certain criteria. The bill would take effect January 1, 2006 and would apply only to an offense committed on or after that date.

Under current statute, when certain cases are dismissed, the justice of the peace or municipal court judge may assess a fee not to exceed $10. In addition to doubling the maximum fee for those offenses, the bill would add other traffic offenses that could be dismissed and for which a fee not to exceed $20 could be assessed.


Local Government Impact

The revenue gain would vary by court and would depend on the number of applicable offenses that are dismissed and whether the court imposes the maximum administrative fee or a lesser amount.

No significant fiscal implication to units of local government is anticipated.
