HB3455 by Castro (Relating to swimming pool safety.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Subtitle A, Title 9, of the Health and Safety Code to add Chapter 761, Pool Safety at Single Family Homes.
 
The bill would define certain safety equipment that would be required with each pool sold or manufactured for use at a single-family home.  The bill would require rules to be adopted by the Executive Commissioner of the Health Human Services Commission relating to proof of ownership of safety equipment.
 
Enforcement would be established to compel sellers and manufacturers to comply with the provisions of the bill.  Enforcement actions could be brought by the person purchasing the pool, the person’s representative, or a government entity.
 
The change in law would apply only to pools sold on or after the effective date of the bill.  The bill would take effect on September 1, 2005.

The Health and Human Services Commission indicated that there would be workload implications for rules development; however, any costs associated with the bill could be absorbed within the agency's existing resources.

No significant fiscal implication to units of local government is anticipated.
