No fiscal implication to the State is anticipated.
The bill would repeal Section 451.069 of the Transportation Code, which provides that certain contractual powers do not create or confer any governmental immunity or limitation of liability on any entity other than a metropolitan rapid transit authority. The repeal of this section of the code would imply that there would be immunity or limited liability conferred on an entity that enters into an agreement with a metropolitan rapid transit authority. The bill would take effect September 1, 2005.
