LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 4, 2005

TO:
Honorable Jim Keffer, Chair, House Committee on Ways & Means

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HJR44 by McReynolds (Proposing a constitutional amendment to authorize an increase in the amount of the ad valorem tax exemptions for veterans who are certified as having certain disability ratings.), As Introduced

No fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $66,497.

The State Constitution and Tax Code Section 11.22(a) grant a disabled veteran a property tax exemption based on a veteran's disability rating. A disability rating of at least 10 percent entitles a veteran to a $5,000 exemption. Greater exemption amounts—ranging from $7,500 to $12,000—are granted for disability ratings "more than" a stated percentage, ranging from 30 percent to 70 percent and over. The proposed amendment to Article VIII, Section 2(b) would replace "more than" with the term "not less than."

The proposed amendment alone would have no fiscal impact on the state or units of local government.  The enabling legislation associated with this proposed constitutional amendment is HB 1051.

Local Government Impact

No fiscal implication to units of local government is anticipated.
