No significant fiscal implication to the State is anticipated.

The bill would amend the Insurance Code to allow the issuer of a health benefit plan to require that a health care professional licensed or registered under the Occupations Code, or a health care facility licensed under the Health and Safety Code, submit a health care claim or equivalent encounter information, a referral certification, or an authorization or eligibility transaction electronically.

The bill would require the Texas Department of Insurance's Health and Licensing Program's Health Maintenance Organization section to add a new review element to provider contracts.  The bill would take effect September 1, 2005.

Based on the analysis of the Texas Department of Insurance, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
