LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 11, 2005

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB57 by Nelson (Relating to county regulation of billboards.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would prohibit a person from erecting an off-premise sign that is adjacent to and visible from a road or portion of a road that lies outside the corporate and extraterritorial limits of a municipality, if designated by order of the governing body of the county where the road is located. A county would have to provide written notice to the Texas Department of Transportation (TxDOT) of its order to prohibit off-premise signs along the applicable roads.

The bill would take effect September 1, 2005.

Based on the analysis of TxDOT, it is assumed that duties and responsibilities associated with the implementation of the bill could be covered by using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
