No significant fiscal implication to the State is anticipated.
The bill would amend Chapter 103 of the Civil Practices and Remedies Code relating to the administrative procedure for compensation for wrongful imprisonment. The bill would remove the requirement that a claimant must file a certification of the person's actual innocence signed by a prosecuting attorney of the county in which the sentence was rendered. To the extent that the bill would lessen administrative costs of processing compensations for wrongful imprisonment, a significant fiscal implication to the State is not anticipated.
The bill would apply only to claims filed on or after the effective date of the bill. The bill would take immediate effect if the bill receives two-thirds of the vote in both houses; otherwise, the bill would take effect September 1, 2005.
