LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 6, 2005

TO:
Honorable Kenneth Armbrister, Chair, Senate Committee on Natural Resources

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB123 by Barrientos (Relating to air quality control measures proposed pursuant to an early action compact. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would direct the Texas Commission on Environmental Quality to consider implementation of air quality control measures proposed by an early action compact area as part of an early action plan. The TCEQ would be authorized to implement any air quality control measures in a near nonattainment area that are authorized or implemented in a nonattainment area. Any additional workload resulting from the bill's passage is expected to be absorbed using existing agency staff and resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. Additional control measures may have a fiscal impact on local governments electing to request those measures. However, the fiscal impact of such measures is not anticipated to be significant since the governmental entities would select which measures to request.
