No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code as it relates to possession of certain devices affecting operation of a traffic-control signal and provides a criminal penalty.

The bill would make it a class B misdemeanor for a person to possess a mobile infrared transmitter capable of changing a traffic-control signal out of sequence. An exception would be if the person possessed the mobile infrared transmitter for use in official emergency response duties, as determined by rules adopted by the Texas Department of Transportation.

The bill would be effective September 1, 2005.
