SB200 by Gallegos (Relating to county authority to regulate vehicular or pedestrian gates to gated communities.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would authorize counties to require the owner or owners association of a gated community, except a community located within the extraterritorial jurisdiction of a municipality, to comply with statutory regulations of vehicular or pedestrian gates. The bill would take effect immediately if it receives the required two-thirds vote in both houses; otherwise, it would take effect September 1, 2005.

Under current statute, a county has authority over regulations of vehicular and pedestrian gates in applicable multi-unit housing projects only. The provisions of the bill would expand a county's authority regarding vehicular and pedestrian gates to include those that are part of a gated community.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
