No significant fiscal implication to the State is anticipated.
The bill would amend the Transportation Code to require an employer who conducts alcohol and drug testing to report a valid positive result of an alcohol or drug test to the Department of Public Safety (DPS) for holders of commercial driver's licenses. The bill would also require the employer to report an adulterated sample or a refusal to provide a specimen for drug or alcohol testing. A refusal or an adulterated specimen would be maintained by DPS in the same manner as a valid positive result. Both the Department of Public Safety and the Department of Transportation report that the requirements of the bill can be accomplished with existing resources.
