No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to stipulate that, other than Section 437.020(b), Chapter 437 would not regulate the provision of produce samples to consumers at a municipally owned farmers' market and that other rules adopted under state law would not apply to those produce samples. 

The bill would add Section 437.020(b) to establish sanitary conditions that must be met for produce samples to be distributed at a municipally owned farmers' market.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

No significant fiscal implication to units of local government is anticipated.
