LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 21, 2005

TO:
Honorable Jeff Wentworth, Chair, Senate Committee on Jurisprudence

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB291 by West, Royce (Relating to the index of court fees and costs.), As Introduced

No fiscal implication to the State is anticipated.

The bill would update the statutory index of court fees and costs to include those currently located in other existing statutes but that previously had not been listed in the comprehensive index. The bill would also repeal the requirement that the Texas Legislative Council review all statutes and prepare a report to update the index of court fees and costs because the report has been published, and enactment of the bill would reflect the findings shown in that report. In addition, maintaining the completeness of the list would exist as a permanent statutory requirement of the Texas Legislative Council. The bill would take effect September 1, 2005, and in any conflict with other statutes, the index of fees would prevail.

Local Government Impact

No fiscal implication to units of local government is anticipated.
