No fiscal implication to the State is anticipated.

The bill would add to the definition of "public nuisance" maintaining on any property in a neighborhood in a county with a population of more than 1.1 million, a swimming pool that is not protected as required by statute. The bill would take effect September 1, 2005 and would apply only to a swimming pool constructed or installed on or after that date, or located on property sold on or after that date.

The population restriction would apply to Bexar, Tarrant, Dallas, and Harris counties. It is anticipated that costs for enforcement of an additional public nuisance requirement would be insignificant.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
