LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 14, 2005

TO:
Honorable Troy Fraser, Chair, Senate Committee on Business & Commerce

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB359 by Harris (Relating to notice regarding rental car damage waivers.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 3(b), Article 9026c, Revised Statutes.  Section 3(b) would revise the first section of the Notice to Texas Residents Regarding Damage Waivers with a notice to consumers that their current vehicle insurance may or may not cover a rental vehicle and before deciding whether or not to purchase a damage waiver they may want to check their current policy regarding coverage for rental damage or loss.

This Act takes effect immediately if it receives a vote of two-thirds of all the members of each house, otherwise this Act takes effect on September 1, 2005.

The proposed legislation may result in new complaints, investigations or cases by the OAG, however, it is projected that this increase can be absorbed by current resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
