The bill would amend the Penal Code by establishing as a Class A misdemeanor offense the act of trespassing on a critical infrastructure facility. The bill defines a critical infrastructure facility and addresses courtroom procedures for the punishment phase of this crime. The bill would take effect on September 1, 2005, and would apply only to an offense committed on or after that date.
Enforcement, courtroom activities, and penalties imposed related to the proposed offense are not expected to have a significant fiscal impact.
