The bill would authorize a person whose social security number or driver's license number is included in a deed or deed of trust transferring an interest in real property to remove or strike that information from the publicly filed record. The county clerk would be required to accept an instrument even if the notice of confidentiality rights is not properly implemented. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005 and would apply only to instruments filed on or after the effective date.
The proposed changes to statute are not substantive.
