No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to the provision of certain information regarding free and discounted drugs by the Board of Pharmacy (Board). The bill would require the Board to contact pharmaceutical companies about information on free or discounted drug offers and post that information on the Board’s internet website and notify all Board licensees. The Department of State Health Services (DSHS) would be required to notify all city and county health departments, hospital districts, and other governmental health care providers of the information on the Board’s website. Based on the Board and DSHS’ analysis, it is assumed that the provisions of the bill could be implemented using existing resources and would not have a significant fiscal impact.

 

The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution; otherwise, the bill would take effect September 1, 2005.
