FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 7, 2005

TO:
Honorable Kenneth Armbrister, Chair, Senate Committee on Natural Resources

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB519 by Armbrister (Relating to compliance histories for and incentives to reward compliance performance by entities regulated by the Texas Commission on Environmental Quality.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would modify requirements relating to the Texas Commission on Environmental Quality's (TCEQ) performanced-based regulation procedures. The bill would amend compliance history rules, prompting the need for several divisions to participate in the rulemaking process.

The TCEQ would be required to revise polcies and do rulemaking. Several of the agency's databases also would have to be modified. Any additional workload as a result of the bill's enactment is not expected to result in significant costs to the agency.

Local Government Impact

No fiscal implication to units of local government is anticipated.
