No fiscal implication to the State is anticipated.

The bill would amend the Government Code to authorize a county to pay the salary of bailiffs in certain district courts from the courthouse security fund. The bill would also amend the Code of Criminal Procedure to authorize the use of the courthouse security fee to include financing security personnel for a district, county, justice, or municipal court, as appropriate. The bill would take effect September 1, 2005.

Under current statute, the bailiffs in the applicable courts must be paid out of the county's general fund. Current statute regarding use of the courthouse security fee does not include financing personnel specifically employed as security personnel.


Local Government Impact

No significant fiscal implication to units of local government is anticipated as a result of the proposed changes in use of existing funds, although the change could create a savings to the local government's general revenue fund.
