No fiscal implication to the State is anticipated.
The bill would amend Chapter 245, Local Government Code, relating to issuance of local permits as they pertain to landscaping or tree preservation, open space, park dedication, or property classification. The bill would waive a political subdivision's immunity from suit in regard to an action under Chapter 245. The bill would take effect September 1, 2005.
Local Government Impact
The amendments regarding issuance of permits would have an insignificant fiscal impact. If a suit arises, waiving a political subdivision's immunity from suit would lead to incurring legal costs and, if the entity loses the suit, the costs of paying damages.
