LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 2, 2005

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB644 by Wentworth (Relating to the eligibility of persons to participate in the public sale in certain counties of certain real property.), As Introduced

No fiscal implication to the State is anticipated.

The bill would limit the counties in which a person is eligible to purchase certain real property for sale by the county to those counties with a population of 250,000 or more and to counties with a population of less than 250,000 in which the commissioners court by order has adopted the provisions of Section 34.0445, Civil Practice and Remedies Code and Section 34.015, Tax Code.

Under current statute, persons meeting certain criteria are eligible in all counties to purchase certain real property, regardless of population size or codes adopted by order by the commissioners court.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
