LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 19, 2005

TO:
Honorable Kino Flores, Chair, House Committee on Licensing & Administrative Procedures

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB707 by Van de Putte (relating to the issuance of an electrician license without examination to certain applicants. ), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code by stating that the Department of Licensing and Regulation (TDLR) shall issue a license without examination to an individual who was on active duty in the United States armed forces during the period of March 1, 2004, to June 1, 2004, submits an application and any other information no later than the 90th day after the date the individual is released or discharged from active duty in the armed forces, has the experience required for a license under this chapter, and pays the application fee. The bill would also require TDLR to issue a license without examination to an individual who holds a license to perform electrical work by a municipality that elects to discontinue the municipality’s licensing program if the licensee held the municipal license for the preceding year, has the experience required for a license under this chapter, and submits an application no later than the 90th day after the date the municipal or regional program is discontinued. Based on TDLR’s analysis, it is assumed that the provisions of the bill could be implemented using existing resources.

The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution; otherwise, the bill would take effect September 1, 2005.

Local Government Impact

No fiscal implication to units of local government is anticipated.
