No significant fiscal implication to the State is anticipated.

The bill would amend the Public Information Act and makes the Office of the Attorney General the state agency responsible for the administration of the Act by removing references to the General Services Commission (currently the Building and Procurement Commission).  The bill also establishes timeframes in which a requestor has to review certain materials as well as the timeframe to respond to a cost statement provided to a requestor.

The bill would amend the Government Code and transfer administration of the Public Information Act from the Texas Building and Procurement Commission (TBPC) to the Office of the Attorney (OAG). All personnel employed by the TBPC who perform functions under the Act, totaling 1 FTE, and all appropriations for performing those duties, totaling approximately $50,000 in General Revenue, would be transferred to the OAG. It is assumed that any costs associated with physically moving staff from TBPC to the OAG could be absorbed within existing state resources.
