The bill would amend the Local Government Code to add a multi-family residential dwelling consisting of four or more units in unincorporated areas of a county to the building construction for which a county is authorized to adopt fire codes. Building construction would include substantial improvements and the bill would set requirements to which the fire code must conform.
The bill would also extend from two business days to five days the amount of time a county would be allowed from the time it receives an inspection request and when the inspection would have to begin. If the building does not comply with the fire code, the county would be required to deny the certificate of compliance and the building could not be occupied.
A fee for the fire code inspection must be reasonable and reflect the approximate cost of the inspection personnel, materials, and administrative overhead.
The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
