LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 2, 2005

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB736 by Brimer (Relating to county authority to adopt fire codes in unincorporated areas.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to add a multi-family dwelling in unincorporated areas to the building construction for which a county is authorized to adopt fire codes. The bill would also extend from 2 days to 10 days the amount of time a county would be allowed from the time it receives an inspection request and when the inspection would have to begin. If the building does not comply with the fire code, the county would be required to deny the certificate of compliance and the building could not be occupied. The bill would take effect September 1, 2005.

Local Government Impact

Counties would incur costs associated with inspections and code enforcement, although those costs are not anticipated to be significant.

No significant fiscal implication to units of local government is anticipated.
