No significant fiscal implication to the State is anticipated.

The bill would require operators of quarries to obtain permits from the Texas Commission on Environmental Quality (TCEQ). It would also prohibit the TCEQ from issuing permits to rock crushers located within one mile of certain facilities located over an aquifer designated as a sole source aquifer under the federal Safe Drinking Water Act. The provisions of the bill would apply to a quarry that includes a rock crusher for which an application for an air quality permit was received by the commission on or before July 1, 2003 and was not issued before September 1, 2005.

 

The TCEQ reports the provisions of the bill would only affect one quarry at present time. It is assumed any costs to the TCEQ in administering the permit program required by the bill could be accomplished with current agency resources.

 

The bill would take effect September 1, 2005.
