LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 20, 2005

TO:
Honorable Jeff Wentworth, Chair, Senate Committee on Jurisprudence

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB838 by Wentworth (Relating to the reporting and collection of certain information regarding persons found not guilty of an offense by reason of insanity.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require the Executive Commissioner of the Health and Human Services Commission to collect information and maintain current records of persons found not guilty of an offense by reason of insanity (under Article 46.03 of the Code of Criminal Procedure) who are ordered to receive inpatient mental health services or are committed for long-term placement in a residential care facility.

The Department of State Health Services states that the bill would require activities which are already current practice.  It is assumed that non-institutional providers would assist facilities in tracking individuals once they leave the state facility.  Therefore, no significant fiscal impact is anticipated.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
